These Terms & Conditions of Use and Sale (the "Terms") govern access to and use of the xFer service (the "Service"), published by Steeve Aukingso / Kreative Monster, available at kxfer.app. xFer is a premium file delivery tool for creators (photographers, videographers, UGC creators, studios). By creating an account or using the Service, you accept these Terms without reservation.

The Service is available 24/7, except for maintenance interruptions or events beyond our control. Access may require an invitation during the launch phase. You must have internet access and compatible equipment, at your own cost.

Creating an account requires a valid email address and, optionally, a name. Authentication is done via magic link. You are responsible for the confidentiality of your access and for any activity carried out from your account. You agree to provide accurate information and keep it up to date. You must be of legal age or have authorization from your legal guardian.

The Service offers the following plans, in euros, all taxes included, with secure payment via Stripe:

• Creator€9 / month
• Pro€29 / month
• Studio€79 / month
• One-Shot€9 / delivery· one-time purchase, no subscription

Prices may change; any change will be notified and will not affect current subscriptions before their next renewal. Payment triggers immediate access to the chosen plan's features.

Subscriptions (Creator, Pro, Studio) are monthly and automatically renewed. You can cancel at any time from the Stripe billing portal; cancellation takes effect at the end of the current period, with no pro-rated refund for remaining days.

Under French consumer law, consumers have a 14-day right of withdrawal for services not yet performed. By requesting immediate performance of the Service (for example by creating a delivery), you acknowledge waiving this right for the portion already performed. Since the One-Shot plan is a service performed immediately, the right of withdrawal no longer applies once it is used.

xFer is provided "as is." You are solely responsible for the files you upload, their legality, and the rights you hold over them. xFer cannot be held liable for indirect damages, data loss, or interruptions beyond its control. The publisher's liability, if engaged, would be limited to the amount paid over the past 12 months.

It is strictly prohibited to upload or deliver via the Service:

• illegal, infringing content or content violating third-party rights;
• child sexual abuse material or content of a similar nature;
• malware, viruses or malicious scripts;
• hateful, defamatory content or content inciting violence;
• third-party personal data without a legal basis.

Any abuse may result in the immediate deactivation of a link and account suspension, without notice or refund.

You retain full rights over the files you deliver. xFer claims no rights over your content and does not use it to train any AI model without your explicit consent. The xFer brand, its interface and its code remain the property of Kreative Monster.

We implement reasonable means to ensure the Service's availability, without guaranteeing uninterrupted operation. Maintenance operations may be scheduled. Delivery files and links expire automatically according to the durations defined by your plan.

xFer reserves the right to modify these Terms at any time. Users will be notified of substantial changes by email or via the Service. Continued use constitutes acceptance of the new Terms.

These Terms are governed by French law. In case of a dispute, an amicable solution will be sought first by writing to steeve@aukingso.com. Failing that, the consumer may resort to a consumer mediator or the European Online Dispute Resolution platform. French courts have jurisdiction.
